Overview of Family Law Property Settlement

Family property settlement involves dividing assets, liabilities, and financial resources between separating partners. This process applies to married couples, de facto relationships, and same-sex partnerships. Unlike common misconceptions, property division doesn’t automatically occur at separation; it requires formal legal agreement or Court determination.

The settlement encompasses all matrimonial property, including:

• Bank accounts, savings, and investments
• Debts, mortgages, and loans

Australian family law act follows a four-step framework for determining fair property division. 

1. First, all assets and liabilities are identified and valued to establish the total property pool. 
2. Second, each party’s contributions – both financial and non-financial, including domestic and parenting responsibilities – are assessed. 
3. Third, future needs are considered, including age, health, income capacity, and care arrangements for children. 
4. Finally, the Court determines what division is just and equitable for both parties.

Timing matters significantly. You have limited time to apply for consent orders for property settlement: 12 months from divorce finalisation for married couples, or two years from separation for de facto relationships. Acting promptly protects your legal rights and ensures security for your future.
